1. Acceptance of Terms

By interacting with Banu via WhatsApp or registering on our platform, you accept these Terms of Service and acknowledge that Banu is a software tool designed exclusively for productivity management.

Minimum age: use of Banu is permitted only for individuals 18 years of age or older. By registering or interacting with the service, you represent that you meet this age requirement. If we become aware that a user under 18 has created an account, we will delete it.

Ownership of prompts and instructions: all texts, instructions, and prompts you send to Banu belong to you. Banu makes no claim of intellectual property over your instructions and does not commercialize, share, or use them for any purpose other than executing the requested action.

2. Nature of Software and Incidental Functionality

Banu acts as an automated platform that allows managing operational tasks (alerts, emails, calendar, and records) through instructions. The use of natural language processing and artificial intelligence (AI) technologies within Banu is strictly an incidental and ancillary functionality, whose sole purpose is to interpret instructions to interact with third-party tools. Banu is not a general-purpose artificial intelligence or a conversational chatbot.

3. Third Party Service Providers (TPSP) and Data Training Prohibition

To correctly interpret your commands, Banu integrates with technology providers (such as Anthropic and OpenAI), who operate strictly as Third Party Service Providers (TPSP) in accordance with Meta's policies. It is strictly prohibited to use any user data (Business Solution Data) to create, develop, train, or improve artificial intelligence or machine learning models (AI Models). Data is processed exclusively to fulfill the requested order.

4. Acceptable Use

The user agrees not to use Banu to generate spam, send unsolicited emails, or harass third parties. For your security, we suggest not sharing sensitive financial information or critical personal medical data. We reserve the right to revoke access to any user who violates WhatsApp Business API or Google use policies.

5. Payments, Plans & Cancellation

Paid plans (Plus and Pro) are contracted on a monthly basis. Charges are processed through MercadoPago (Argentina and Brazil). At the end of the paid period, the plan automatically reverts to the Free tier with no additional charge.

You may cancel your plan from your dashboard (usebanu.com/hub) by clicking "Cancel subscription". Upon cancellation, you remain on your current plan until the end of the paid period and are then moved to the Free plan at no additional cost.

5a. Right of Withdrawal and Refund Policy

Withdrawal period: You have the right to request a full refund within 10 (ten) calendar days from the date of purchase, without providing a reason or incurring any penalty. This right applies even if you have used the service during that period.

How to exercise it: Send an email to banu@usebanu.com with the subject "Purchase Withdrawal", including your name, WhatsApp number, plan purchased, and payment date. You can also use the withdrawal button available at usebanu.com.

Confirmation and processing: Banu will confirm receipt of your request within 24 business hours with a reference number. Refunds are credited within 3 to 10 business days via MercadoPago, subject to the payment processor's timelines.

Cancellation after the 10-day window: If the request is received more than 10 calendar days after purchase, no refund applies. The plan remains active until its expiration date and then automatically downgrades to the Free plan.

Legal basis: Argentine Consumer Protection Law 24.240, Art. 34; Civil and Commercial Code of Argentina, Art. 1110; Disposition 954/2025 of the Secretary of Commerce.

Right of withdrawal — Brazil (CDC, Art. 49): The consumer has the right to withdraw from contracts concluded outside a commercial establishment within 7 (seven) days from the date of subscription. To exercise this right, contact banu@usebanu.com.

6. General Limitation of Liability

Banu is provided "as is". While we strive for 100% accuracy in task execution, we are not responsible for data loss, missed appointments, or undelivered emails resulting from outages in third-party platforms (Meta, Google, AI providers) or network failures.

No affiliation with Meta / WhatsApp: Banu is an independent service that uses the official WhatsApp Business API. Banu is not associated with, affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. (Facebook), WhatsApp Inc., or any of their subsidiaries. WhatsApp® is a registered trademark of WhatsApp LLC.

Meta API changes or discontinuation: Banu's operability depends on continued access to the WhatsApp Business Platform API. Meta may modify, restrict, or discontinue that API at any time under its own policies. Banu shall not be liable for any total or partial interruption of the service resulting from changes to the terms, policies, or availability of Meta's API or any other third-party technology provider.

7. Modifications

We reserve the right to modify these terms with at least 15 days' advance notice, communicated by email to banu@usebanu.com and/or via WhatsApp message to registered users. Updates will be posted on this website. Continued use of the service after the notice period constitutes acceptance of the updated terms.

8. Flight Tracking Feature — Specific Limitation of Liability

This section applies exclusively to Pro plan users who use the flight tracking feature.

Nature of service — informational intermediary: Banu is an information aggregator and acts exclusively as a technology intermediary. It has no contractual relationship or affiliation with any airline, travel agency, or airport authority. Alerts issued by Banu do not constitute official communication from any airline and do not replace information provided through the airline's official channels.

User's sole responsibility: the user is solely and exclusively responsible for: arriving at the boarding gate within the times required by the airline; carrying valid travel documents (passport, visa, boarding pass); complying with the immigration, customs, and health requirements of the destination country; and verifying flight information through the airline's official channels before traveling to the airport.

Informational nature: flight information provided by Banu (including schedules, flight status, boarding gates, and last-minute changes) is obtained from external data providers and is provided strictly for informational and guidance purposes only. Banu does not guarantee the accuracy, completeness, or real-time currency of such information.

Data latency and third-party dependency: Banu depends on information that airlines publish in global flight tracking systems. If an airline does not update its boarding gate or other data in its own systems, or does so with a delay, Banu cannot know that data before it becomes available in external sources. We do not guarantee that all updates will be detected or delivered in real time.

Technical and connectivity failures: we do not guarantee that the service will be free from errors, outages, or delays in delivering notifications. Factors outside Banu's control — including but not limited to: WhatsApp (Meta) service interruptions, lack of internet connectivity on the user's device, failures of flight data providers, or scheduled maintenance — may prevent or delay the delivery of alerts without any liability on our part.

Mandatory verification: the user acknowledges that it is their sole responsibility to verify all flight information directly on airport screens, with airline staff, or through the airline's official channels before making any decision based on alerts received from Banu.

Disclaimer of liability: Banu, its operators, employees, and providers shall not be liable under any circumstances for any losses, damages, costs, or harm of any nature (including but not limited to: missed flights, rebooking expenses, unplanned overnight stays, missed connections, ticket change fees, or economic damages of any kind) that may arise directly or indirectly from the use of, reliance on, or action taken based on flight alerts generated by Banu, whether such information proves to be inaccurate, incomplete, outdated, or undelivered due to technical reasons.

Travel documents — we are not custodians: Banu does not hold or replace the boarding pass or any other travel documents. The user must always retain their original boarding pass (physical or digital) and all relevant travel documentation, regardless of any alerts received.

Data limitation: Banu does not store or retain the user's booking reference (PNR/confirmation code). Flight tracking is performed exclusively using the flight number and travel date.

Informed consent: by activating the flight tracking feature and confirming the explicit consent requested by Banu, the user declares to have read, understood, and fully accepted the terms of this section.

9. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Argentina. For the resolution of any dispute arising from or related to these Terms, the parties submit to the exclusive jurisdiction of the Ordinary Courts of the Autonomous City of Buenos Aires, expressly waiving any other venue that may be applicable.

In case of any dispute, the parties may turn to the Argentine National Consumer Defense Directorate or ordinary courts.

Notwithstanding the above, users in Brazil retain the rights granted by the Código de Defesa do Consumidor (Lei 8.078/1990), and users in the European Union retain the rights granted by applicable EU consumer protection legislation, to the extent those rules are mandatorily applicable.
